Please read these General Terms and Conditions (“Terms”) carefully. By using the Services (as defined below), you agree that you have read, understood, accepted and agreed with these Terms. You further agree that the representations below are true and accurate. If you do not agree to any of the terms and conditions stated herein and wish to discontinue using the Services, please do not continue using the services (as defined below)

Limitation of Liability

• If the Company cannot provide the Services due to an occurrence of a Force Majeure Event, the Company shall be exempted from any obligations under these Terms.

• The Company shall not be liable for any disruption in the use of the Services caused by any act or omission of the Member.

• The Services are provided by the Company on an “as is” and “as available” basis without any guarantees, conditions or warranties. Unless expressly stated to the contrary and to
the fullest extent permitted by law, the Company expressly excludes all conditions, warranties, and other terms which might otherwise be implied by statute, common law, or the law of equity and the Company shall not be liable for any damages whatsoever, including, but without limitation, to any direct, indirect, special, consequential, punitive or incidental damages, or damages for personal injury, loss of life, use, profits, data or other intangibles, damages to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of, or related to the use, inability to use, performance or failures of the services, and any materials, information, data, and facts posted by the Member or other members thereon, irrespective of whether such damages were foreseeable or not.

• Without prejudice, the Company’s liability (if any) shall be capped at the total Fees paid by the Member to the Company in the preceding 30 days of the date of the damage suffered.

• The Company shall not be liable for any transactions or dealings between the Member and any third party obtained through the Services.

Vehicles shall not be used for the purposes stated below:-

• For any illegal or unlawful purposes under the state of Malaysian laws;
• For any morally-objectionable purposes;
• In contravention with these Terms;
• In a manner which will cause damage to the Vehicle either interiors or exteriors;
• To be driven to a place outside of Malaysia or another island. Example; Singapore, Thailand, Labuan, Langkawi, Sabah, Sarawak, Tioman, Redang, Pangkor and etc. It is prohibited
to be driven on a non-gazetted road or off-road or even being ferried by boat or ship.
• For any commercial, non-personal purposes, including for use to provide ride e-hailing and ride-sharing services, unless the prior approval of the Company is obtained; and
• For any other purpose of which the Company is of the view that it may cause damage or harm to the Company and/or the public.
• Smoke or use electronic cigarettes in the Vehicle;
• Transport pets.
• Bring durians or raw meat.
• Forge or cover the license plate and/or the road tax of the Vehicle;
• Do any acts that will infringe or jeopardize the Company’s ownership of the Vehicle, including, without limitation, renting out the Vehicle, using the Vehicle as collateral, or
selling the Vehicle;
• Use the Vehicle to tow any other vehicles or heavy objects;
• Keep any drugs or illegal objects in the Vehicle
• Remove, replace or damage any part(s) of the vehicle which shall include the roadtax and any other device(s) or items installed by the Company; and
• Ensure that total number of persons in the Vehicle will not exceed the maximum seating capacity of the Vehicle.
• Sublet or hire the vehicle to any other person
• Permit the vehicle to be operated outside their authority
• Operate the vehicle, or permit it to be operated in any race, speed test, rally or contest
• Operate the vehicle in breach of the transport Act 1987. Operate the vehicle or permit it to be operated for the transport of more than the number of passengers or more than
the weight of passengers, or more than the weight of goods specified in the certificate of loading for the vehicle.
• Drive or permit the vehicle to be driven by any other persons not stated in the vehicle rental agreement at the time of their driving the vehicle the hirer or any other person is
also not the holder of a current driver’s license appropriate for the vehicle.

Returning of the Vehicle

• The hirer shall at or before the expiry of the term of hire, deliver the vehicle to the said location in the schedule, or obtain the company consent to the continuation of the hire. (Note: No refund is available to the hirer if the vehicle is returned earlier than stated in the schedule). The vehicle is to be returned in a clean condition with fuel level to level policy as it was collected. RM500.00 cleaning penalty fee will be charged if there is cigarette ashes seen inside of the car or the car has unpleasant or smoke odour. The vehicle is to be returned with the same amount of fuel as collected or RM20.00 administration fee will apply in addition to the cost of the fuel and If not returned to the location stated, a relocation administration fee of RM 1,000.00 will be charged to collect the vehicle. There is a grace period of 45 minutes to return the vehicle. If Hirer returns past 45 mins, a hourly rate fees depends on vehicle make and model will be charged. Hirer’s must inform to the company at 011-8888 7527 at least 24 hours before the return date and time to avoid penalty charges if they wished to extend the dates and time. Penalty fees will be imposed if extension of duration is informed within 24 hours or less to the company.

Security Deposit

•Security Deposit act as a guarantee of proper usage of the vehicle for the entire duration of the rental period. The security deposit amount will vary by the make and model of the vehicle. The amount of security deposit will be charged upon confirmed reservation/booking together with the payment of the vehicle rental fee. Upon returning the vehicle in the same condition as how it was collected with NO any summon tickets from any government authorities or any sort of damage to the rented vehicle will have their deposit fully refunded upon returning of the car for FOREIGN CLIENTS and for LOCAL CLIENTS the security deposit will be refunded between 7 – 14 working days to make sure there are no damages or summons issued to the car during the entire rental period. If not, full deposit will be forfeited to cover the cost or if needed to will demand the excess outstanding from the said hirer. The hirer also will also bear the additional cost if necessary. Car rental fees and security deposit must be fully paid upon collection of the vehicle.

Breach of Contract

•The company shall have the right to terminate the hirer and take immediate possession of the vehicle if the hirer fails to comply with any terms and conditions of this agreement or if the vehicle is damaged or suspected to be involved in any illegal activities or being suspicious. The termination of the hire under the authority of this clause shall be without prejudice to the other rights of the company and the rights of the hirer under this agreement or otherwise.

Rental Charges

• The charges are calculated based on the 24-hour period from commencement of the Rental Period for Daily and Weekly rentals, A month or monthly rental is calculated based on the calendar month. Daily rental rates will be applied for rental below 7 days. Weekly rental rates will be applied for rental 7 days and above. If the rental is more than 14 days, daily or monthly rate will be calculated based on the number of days. In relation to the monthly rental, any extension of the rental period will be prorated based on calendar month. If your car rental usage time is less than 24 hours, you will still be charged for the full one day rate. However, if your car rental usage time exceeds 24 hours cycle, you must pay the full day rental fee and additional hourly rate. Your total rental rate is calculated based on the information provided at time of reservation. There is no rebate or refund for early return.

• No cancellation within 24 hours after booking is confirmed, otherwise full booking fee will be forfeited.

• If the booking is cancelled on the day of the pickup or is a no show then 100% of the gross rental will be charged and will be forfeited.

• Selected cars come’s with capped daily limit mileage of 200km depending on the number of days rented out for.

• Additional mileage excess charge will be RM0.20 – RM1.00/Kilometer. (Depends on the make and model of the vehicle)

Rates DO NOT INCLUDE or COVER the following items:

Interior Cleaning: The Hirer is liable for all interior upholstery and car mat cleaning if the vehicle is returned with dirty interiors. The Renter is also liable for all interior and exterior damages and/or defects caused by events that do not fall within the normal usage of the vehicle.
• Interior Damages: The Hirer is liable for all damage to instruments, knobs, and fittings in the vehicle.
• Missing, Stolen, Broken, or Missing Accessories: The Hirer is liable for all replacement cost of all missing, stolen, or broken parts during the rental period or vehicle return unless
the vehicle is damaged at the same time during an accident. For example: Helmet, child seat, GPS navigator, spare tires, rims, wheelcap, tools & jacks, lamp, audio set, gear lock, lighter, wiper, switch & control button, mats, rear-view mirror, Keys Remote, TNG card, USb port, HP Holder, first aid kit, Fire extinguisher, side view mirror, sun visor, head rest, etc. Lost or damaged supplementary parts or accessories will be the responsibility of the hirer.
• Lost Vehicle Keys/Duplicate Vehicle Keys: The Renter is liable for all replacement costs, which include a new set of keys and security system, and or whatever items pertain to the lost vehicle keys and vehicle alarm system.
• If the Hirer is found to breach the conditions mentioned above, the hirer shall be liable for all expenses incurred, including under-carriage repair, cleaning, and interior upholstery.
• Grand Homes Venture (M) Sdn Bhd is and shall not be liable for any missing, stolen, or broken items from the hirer’s belongings during the vehicle's return for servicing and maintenance. It is advisable for the hirer to remove their valuable belongings when the vehicle returns for servicing and maintenance or returning of vehicle. For example, laptops, watches, sunglasses, notes, coins, touch & go card, shoes, smart tags, and others.

Speed Limit Advisory

• The Renter shall not exceed 110 km/h. Exceeding this limit after 3 times warning will result to penalty charge of RM 300 or Deposit will be forfeited.

Prohibition of Use of Vehicles

The Company shall have the discretion to report or notify the competent authorities if the Vehicle is used for, or the Company has reason to believe that the Vehicle is used for, prohibited purposes other than the permitted use. If the Hirer is found to breach the conditions mentioned below, the hirer shall be liable for all expenses incurred, including under- carriage repair, cleaning, interior upholstery and etc. The Company reserves the right to refuse the Services to any Hirer who contravenes this Article.

Parking Fees & Toll Charges

• All parking fees and toll charges shall be borne by the Hirer. The Hirer shall use his own cash or TNG card provided by the company upon request or other payment method to pay for the parking fees and toll charges.

In case of Accident

• If the vehicle is involved in an accident, is damaged, breaks down or requires repair or salvage, regardless of cause, the Hirer shall notify the company of the full circumstances by Call/Whatsapp immediately at 011-8888 7527 with pictures of the damages and surrounding and also make police report within 24 hours if involved in an accident while waiting for further instructions by the company. Any towing or unwanted activities involve with the car you should make a call first to 011-8888 7527. The Renter SHALL NOT arrange or undertake any repairs or salvage without the company authorization (this includes, but is not limited to, purchasing a replacement tyre, battery and etc) except to the extent that repairs or salvage are necessary to prevent further- damage to the vehicle or to other property with original receipt. Without official receipt, the hirer will not be able to claim from the company.
The vehicle claim insurance only covers for the vehicle, not the passengers.

In case of Fines/Summons

• All penalties related to traffic and/or parking offences from the JPJ,TRAFFIC POLICE, PDRM or any other relevant authorities is the responsibility of the Renter and will charge the Renter's credit card, security deposit or demand the excess through cash or online transfer if there is any outstanding sum for any traffic and/or parking offence infringement fees incurred by the Renter and/or any sort of document letter sent to the company’s office. The renter undertakes, in the event that the hirer receives notice of any traffic or parking offenses incurred by the hirer, to send a copy of any such notice to the company as soon as is practicable and to provide the necessary information to the relevant issuing authority for such notices to be directed to the hirer. The hirer has the right to complain about, query or object to the alleged offence to the issuing enforcement authority and has a right to seek a court hearing. Any summon tickets by the hirer paid by the company will be charged additional administration fee of RM100. Speed limit for highway in Malaysia is 110km/h, while Federal and state roads is 90km/h under Malaysian traffic law. Please drive carefully and obey traffic rules.

In case of Stolen Vehicles

• It’s the renter responsibilities to take good care of the vehicle when using it including parking at the safe location and locking it safely. If the vehicle is lost or stolen, Take pictures of the surroundings and location stolen or lost and contact the company at 011-8888 7527 immediately and also make a police report within 24 hours. All monthly payment of vehicles rented by the hirer is to be settled with the bank by the hirer and hirer will bear all the monthly payments while the company makes a claim from its insurance company.

In case of involving in illegal activities

• Hirer are not allowed to do any illegal activities under Malaysian state of law. We will give 100% commitment to the Malaysian Court and Police of Malaysia (PDRM) if you are subjected to criminal activities while using our car. All the Illegal activities will fall under hirer’s obligation. The hirer is prohibited to use the vehicle for any illegal purposed such as delivery drugs, weapons, and or any subject matters that are prohibited in Malaysia.

Persons who may Drive

• The vehicle may be driven during the full period of the hire only by the person named stated in the VEHICLE RENTAL AGREEMENT, and only if they hold a valid Malaysian driver’s license or valid international driving license with valid IDL/IDP permit and above 21 Years of age which must be presented at time of pickup. (Note: all Driver’s Licenses must be in ENGLISH or have an authorized ENGLISH translation, or hold an International Driving license and Permit of the country of origin. Driver’s License must also be present upon collecting the car. Probationary or Restricted Licenses shall not be accepted.

Payment By Renter

•The Hirer shall pay the company in full prior to dispatch (as payment for the hire of the vehicle for the agreed period) the sum specified in the schedule including security deposits. The Hirer must have a Credit Card, Debit Card or Cash. The Hirer agrees to pay any additional costs in connection with the hire including (but not limited to) parking, toll road and speeding and traffic fines, damages to the vehicle, puncture repair and relocation and cleaning fees as incurred in connection with the Hirer’s possession of the vehicle, including those that become apparent following the termination of the hire. The Hirer authorizes the Company to debit their Credit Card, Debit card or Use of Cash.
• In addition to the payment the Hirer shall pay to the Company the sums specified in the schedule for insurance cover as set out in the agreement.
•The Renter shall pay for all petrol or diesel used in the vehicle during the period of the hire and return it back in the same level as collected. Administration fees will be charged addition to the cost of the fuel.
• The following Payment will be accepted: QR Pay, Credit Card, Debit Card Online Bank Transfer or Cash.

Vehicle Insurance

•Third party cover is included in the quoted rate by AXA Affin Insurance, Great Eastern General Insurance Berhad (Malaysia). The third party option covers for all damage to a
third party vehicle in the unlikely event of an accident.
• Third party cover does not cover the Renter, tyre, exterior body, undercarriage body or single vehicle accidents.

Collection of the Vehicle

•Bring along a photocopy of your identity card/passport, driving licenses, business card or any relevant document to verify your home/working address.
• During vehicle collection, the hirer is required to check for any damage or missing part to the vehicles. If the hirer found any damage or missing part that is not reported earlier
will be considered under hirer responsibility.

The vehicle is to be returned in a clean condition with fuel level to level policy as it was collected

Toddlers/Child Safety Seat

•The Toddler/Child car safety seat is available at RM20 per rental. Pre-booking is required. A missing or damaged Toddler/Child safety seat will be charged RM700.

Delivery & Collection Fees

• Delivery and collection fees will be charged based on the distance and according to per/trip basis.
• Additional charges of RM50 for delivery and collection before and after office hours.

Additional Driver

• Additional drivers will be charged RM50 per person. All additional drivers must be present register upon collection of the vehicle and subject to this terms and conditions. The
company reserve the rights to charge any amount of penalties if the main hirer hand over the vehicles to unauthorized driver.

Long Term Rental/Leasing

• For commercial use, Company SSM details is required for verification purposes

• The hirer using the vehicle must be authorized by the company to be is responsible to return the car at our office if the car is due for servicing. We reserve the right to charge penalty of RM2.00 per KM after 500 KM exceeding the service limit.

• For 3 months rental and above, a one-month security deposit is required.

• Monthly rentals will be billed on the first calender day of the month for rental of 2 months and above.

• In the event of late payment, an interest charge of 10% per month will be imposed. • The deposit cannot be used to pay for the future monthly rentals.

• Early termination of 3 months rental and above are not allowed to terminate the vehicle rental agreement prior to its expiration date.
